Signed/Unsigned NIP's

As the regular lot will know, muggins here has been caught at 58 in a 50 and offered three bonus points as a privelage... Now, the NIP is in mum's name as it was her car, if she sends the NIP back naming me and signs it, I assume a NIP will come to me offering me the three points etc etc.
If I get an agent to fill this NIP in, and not sign it - can I use the S172 argument of no statutory requirement to sign and have my afternoon in court, or will it be a case of "tough... we have signed evidence that suggests you're the driver, hard luck - have more points and an even bigger fine"

Not a BiB, nor a solicitor, merely an anyone. However, your mum's signed NIP naming you is not evidence that you were driving at the time of the speeding incident; she wasn't there.
