Parental Responsibility and children
Discussion
I know there was a similar thread a couple of weeks back, but the search function just crashes on me when I try using it, so please suffer my question:
I've a 7yr old girl who I have to my ex-wife. We were married and lived together for 5 years before divorcing (her infidelity) last year. I am registered as the father on the birth certificate. I have my daughter every weekend.
My question is what are my rights and where do I stand with parental responsibility and what chance does my ex-wife have of taking my daughter off to live out of the country - Dubai has been threatened?
Many thanks in advance for any help / advice you can offer.

Can't help with much of your problem but I do know that if you were married to the mother and get/got divorced then you automatically get parental responsibilty. This will help move things along a lot quicker as this can take months to get through a court and cost anything up to £30k!

My understanding is that is she takes the child out of the country without your consent it is child abduction. There is a specific offence.

Seems they can do it long term but only via the courts if you object.

The father of a child automatically has parental responsibility if they were unmarried at the time of the birth, got married and then divorced later. The PR law changed in December 03 such that, if the birth was registered before that date an unmarried father did NOT automatically get PR. After that date, an unmarried father does get PR if he's named on the birth cert. But ultimately, you got married so you have PR.

go to sol and get an order stating that daughter is not to be removed from uk without your consent.
to be safe.
as you married her then yes you have PR
you can take a prohibited steps order to stop her moving with your child
or if she did move abroad then she would be responisble for making sure and helping with costs of keeping contact going between you and your child
