Hi. My first post to this forum so please don't shout at me too much 
My question is... if you are caught speeding and have to go to court when are the points valid from? Is it the time you were caught or when the court applies them ? i.e they expire 3 years later, so when is it 3 years from ?

Think its the conviction date which is the court date if you went to court.
If you accepted the conditional offer, conviction date is listed as the date of the offense.
There is some weird law about the points being on your licesnse for 4 years though - i.e. the points last for 3 years but are not removed from your license until 4 years have passed - dunno if thats still true or not, and I never really understood the logicl behind it - anyone care to comment ....???

Yeh - if you go to court it's the court date they start, if you sign the offer it's the conviction date.
And for most offences, it's three years for totting up and four (maybe even five) years on your licence.
For serious offences, such as drink driving it is ten years on your licence regardless of ban/points/fine.

I've just spoken to my solicitor and he decided to ring the court to find the definitive answer.
Points are actually valid from the date of the offence and not the conviction in court.
Therefore next month I go to court to have 3 points added to a clean licence and be banned. Why? Because I had 9 earlier in the year when I was caught speeding. Two weeks after the offence 3 of my points expired and 9 have expired since. Talk about bad luck !

Either drive like a saint or invest in something like a road angel - that alerts you when traps are nigh. No matter how much you drive like a saint - there's bound to be one late evening when you're driving home and you're speed happens to creep over the limit and suddenly FLASH - you're done. Despite the fact that a quiet street in the middle of the night has the same restrictions as busy high street on a Sat afternoon, with lemming high-street shoppers ready to break-test you at any instance!!! Think I need to invest in one after my recent experience too!!!

I think you are mis-reading is post. He was driving along the road and at that moment in time had 9 points on his licence. He was caught speeding and therefore potentially will gain at least another 3, and hence a ban under the totting up procedure.
However 2 weeks after he was caught speeding 3 of the 9 points became time expired, therefore leaving 6. Those 6 (although he states 9!) have also become time expired since the speeding offence and today. Therefore today he has a court appearance pending with the potential of 3 or more additional points.
The offense causing the original 9 points has not been identified to us.
