Private individual agrees to buy used car. Price agreed and deposit paid subject to satisfactory 3rd party inspection.

Inspection finds issues with car. Buyer still wants to proceed but attempts to re-negotiate price on the basis of outcome of inspection to cover costs of putting right the issues..

Seller won’t budge and says take it or leave it on the basis of price originally agreed.

Buyer insists that either price is reduced by an amount sufficient to put right issues or that seller refunds costs of inspection and other costs incurred to date, claiming that vehicle has been miss-described ( vehicle was advertised as being in excellent condition, inspection suggests otherwise) and threatens County Court proceedings on basis of breach of contract on grounds of misrepresentation.

Private sale, all contracts verbal upto this point with exception of written receipt for deposit simply confirming amount received as deposit against car.

Would the buyers CC claim have any chance of success ?

They're both idiots for not agreeing who pays for the inspection if the car fails and the sale falls through.

Split the difference.

Seller laughs their tits off and tells buyer to do one. The end.

Purely hyperthetical, but no, assume car in same condition as it was when price agreed.

If the seller had obviously lied on the ad (and I could prove it) then I might consider the small claims court. Otherwise, no chance.

Advice would be to see the citizens advice bureau.

I think that unless they have agreed beforehand that the seller will bear the cost of the inspection if problems are found then the buyer will have to pay the inspection cost, and as someone else sad, buyer will tell seller to .censored off!

So long as the seller has told no direct lies (ie he honestly didn't know about any issues) then I can't see what he's done wrong...surely the point of an inspection is for the buyer to be sure the car he's buying isn't a lemon....if he then subsequently doesn't want the car that's his decision..as it is the seller's on whether or not to adjust his price..

I would give back deposit and tell him to whistle on the inspection cost you did not ask him to or agree to any terms if he did !!! from experience I would never place a deposit on a car that I had not inspected properly made that mistake in the past.
