Does anyone know about these companies.

Neighbour had problem with cc and offered payment plan due to redundancy.

Account was 'sold' to 1st credit recently and now they have sent letter stating that connaught (part of 1st credit ) has the intention to isue a statutory demand under the insolvency act 1986 (bankruptcy) as they are unaware of any valid reason for non-payment !

Even though a payment plan was offered according to her.

The letter then states that she should contact them to arrange a mutual convenient time for date and service !

According to her she has offered a payment to clear the balance over 24 months but they are ignoring this .

Does she have any rights now or is this company just been a 'bully' ?

Send another letter with a checque to cover the first payment and see if they cash it?

If they cash it, i would imagine they would find it hard to then prosecute for non payment.

I thought the OP said it was to do with CC, so that isn't in dispute ?

Ask them to provide a copy of the agreement they're chasing first if this hasnt already been done

Hi Mrs Trackside
Thanks for your replies.

As I understand it she had a Credit Card which she didnt miss a payment on until redundancy and then she agreed a payment plan but account was bought by 1st Credit.
When she calls they are rude to her / laugh and generally are not very professional which causes more stress to the situation.

She's very upset at the situation.

Absolutly, if they dont have the credit agreement, then they can't chase for it

Debt Collection Agencies are without exception bullies. In fact they are the scum of the earth

Look on here for advice.

Debt Collection Agencies are without exception bullies. In fact they are the scum of the earth

Look on here for advice.
I wouldn't say that about all of them. They are usually just trying to collect what is owed as quickly as possible, some use dubious practices, but that could be said about many industries.

read of some companies converting CC debt into a mortgage debt, the debt gets called in and the house gets sold cheaply, with lots of fees added on to increase the earning
