My wife received a text saying that she'd entered a monthly competition (cost £5 per month), which she hadn't, and that if she wanted to unsubscribe she had to text unsubscribe back to the number in the text. I suggested she ignore it, thinking that the number in the text would be some premium rate one and that was how the scam worked.
She called ICSTIS and was told this company had already been in trouble once before and that she would have to text them back to remove her subscription otherwise they would charge her the amount. She then called vodaphone, who were unsurprised by this - a common occurrence it would seem. Luckily no charge has been made - yet. They took her details and will be using then for a prosecution.
What I can't understand is how a company can do this. She only uses her phone for calls, has never ever sent a text to one of these companies so how can they physically take money off her. So how can they randomly pick a mobile number and then charge money to it - I don't see how this is possible?

the government won't change the law that says unless you say *no*, it means yes.

Our company offers a text service similar to that one. The problem with them is that anyone can enter your number on a website that we advertise on, thus 'signing you up' without your knowledge or consent. It should be illegal in my opinion and puts off more customers than it attracts as far as i can tell.
If you have never responded to a text sent to the phone then they are obliged to provide you with a full refund - as you have never confirmed the subscription.
Bear in mind that even replying STOP or NO can with some unscrupulous companies mean confirmation of subscription...
