False advertising? Mobile phones on a "plan"...

So I went down to my local mobile shop today and they had a nice little mobile PDA type thing retailing for around $200. Good value I thought , looked around and there was no text that said you had to have it on a plan . Asked the sales girl for one and she said to me "You have to have it on a plan"!

Can they legally do this without advertising that it has to be on a plan?

I have a good mind to write to the advertising standards authority!

Nor was there any text saying that $200 is for a new one in a box.
They'll sell you that particular item (ie the shop dummy) for $200.

Its generally accepted that dicsounted phones are only when you sign a contract.

They certainly can't. Hose the shop in petrol, toss in a mobile phone and call it. As we all know this will light the fuel. When the assistant comes out burning say 'sorry I would piss on you but I only piss on girls in a contract, are you wearing a ring - no.

It's a "mobile phone", selling me some plastic may come under "unfit for purpose of sale".
