Got my car back from the garage today and they replaced a brake bulb that had blown (seemed fine to me at the weekenmd, but hey) so it seems I've been driving round with only 2 of 3 brakelights working, so was this legal since older cars don't have high level lights?

I think if you have any light fitted it has to work. Silly if you have plenty of lights but I'm sure that's how it stands.

I agree, if it is fitted, is has to work. The law does not say 'two brake lights must be working'. IMHO if you got pulled you would just get a verbal request to fix it, or if you were obnoxious to the BiB maybe a vehicle defect report, requiring repair and presentment of the car to an MOT station for signing off.

I agree, if its fitted then it must work.
However,personally,i would be more concerned if one of the other 'normal' mounted brake lights were defective.

Chances are that in reality, if the high vis brake light wasnt working then the chances are that you wouldnt get pulled up.Even if you did, i cant see it being more than a warning.

Sadly there are jobsworths everywhere....fact of life sadly.
Even in the Fish and Chip shop last night

I would have said.. the high vis ones are not part of the MOT requirement, and therefore not prosecutable. they are mearly fashion accessories, and not a requirement.

The high level lamp *is* part of the MOT:

High level stop lamps

These are lamps usually fitted in the rear window or boot spoiler of a vehicle and may consist of a number of light sources .
The lamp is one unit, so as long as at least one of the light sources illuminates when the brake pedal is pressed the lamp is deemed to be working.

so if you put one of those cheapy halford jobs on your parcel shelf, it has to work or you fail the MOT?

My old S4 had one in the window, but the spoiler blocked its view anyway...

too right mate, one of my mates got stopped recently nr london on his moped for allegedly speeding. The cop said he was doing over 50 in a 40 (but had no gun reading just following in car) my mate denied it (and unless it was down hill his crappy gilera could only hit about 45 anyway!!) So the snidey little copper did him for having only 1 L plate on his bike!!! he's only got 1 number plate for gods sake!! Jobsworths
