Neighbour to put up babred wire.

10am this moring i get a knock on the door, and it's the neighbour that backs on to our house. He tells me that he has had enough of our dog running into the garden and so he is going to put up babred wire to stop the dog from entering the garden.
Is he allowed to do this, knowing that it will injure the dog, if he runs through the fence?
Now to give you some history:
We moved in about 3 years ago, we have a long garden and at the end is an ivy bush that is as wide as the garden. This bush was planted by said neighbour some years back, out of spite to the people that used to live in our house to block out some light; we have a south facing garden.
Over the years the kids from his garden would play with the kids of the previous owners and now there are some holes in the bush, which the dog now runs through. The dog never used to run through the bush and this only came about when the kids from next door started to call him over and intice him. The dog would get excited and then run through, only to be locked in the house all day when he came back through or until the kids were not in the garden.
Now given that this bush was planted by him in the first place, instead of a proper fence going up, i told him that he needed to cover the holes as it's his fence, I've managed to cover most of the holes except one, and this is causing the problem.
His reply was that as the dog was coming from our side, we needed to put in a barrier.
Look forwards to your advice.

If the dog won't jump a fence then a stock-proof fence is all thats reqired, this is a wide spaced mesh and usually in the case of a farmer the top and bottom are dressed with barbed wire. However you don't need barbed wire and just normal straight wire would do.
But I would say that this is a lack of communication:-
1) You need to control yor dog, it is your responsibility
2) He needs not to over-reacy putting up barbed wire which is likely to cause injuy to a child.
Go talk to him, say that you want to control your dog, and can you work out something between you that will satisfy both parties.

Barbed wire seems a bit extreme!
Now I am not a dog lover, so a neighbours dog coming into my garden would pi55 me off a bit.
However, how reasonable is this man. Can a proper fence be errected at a shared cost.
Get rid of the Ivy and you have your light back also.

don't inflame the situation... scoring points just won't be worth it in the long run

suggest that barbed wire is probably a bad idea, a last resort
and tell him you will get the holes barricaded up suitably
go back home and get the holes filled in
dont mention that its illegal or anything.... it won't help at all
AFTER thats all done... go round again and ask him politely if he can get his kids to stop calling the dog

Why not just apologiser to him for the obvious inconvenience and stress your dog is causing him and go down the local Wickes and get some fence posts and either some 6ft fencing panels (tenner each) or some trellis (even cheaper) and mamke a nice boundary your side that will stop your dog going in.
Clearly he is at the end of his tether and all your attempts to secure your dog so far have failed. In the interests of good neighbourly relations, you should do a proper job to keep your dog on your land.
A days work and about £8o will probly do it! Your solicitor will charge twice that for a letter to him.....
I can never understand why people seem to be unable to talk and sort out neighbour disputes....it seems to be so damned easy most of the time!

The dog does listen to me and will obey my command even out side as soon as i catch him going through the hole i call and he comes back. But the problem came about because of this bush, his kids call the dog over.
What i would really like to know is the legality (sp?) of him putting up bared wire with the intent to stop/harm and animal getting into the garden?

I used to live in an end terrace and the people in the next house had a dog that could jump the fence into my garden. Basically what it did was jump the fence, have a dump in my garden then jump back. It used to really peeve me that i was cleaning up dog s
te when i didnt have a dog. So i then started leaving the side gate open, so dog jumped fence and got out. So the neighbour would then come round and CLOSE MY GATE so that the dog could continue to jump the fence and dump in my garden without risk of it getting out.
So i took the gate off....
To the O/P - sort out a fence on YOUR side to stop YOUR dog annoying your neighbours. Its YOUR responsibility. We've two dogs now and i make sure they cant get out - i certainly dont make it my neighbours responsibility to stop them getting in.
