AN OFF-DUTY police constable found asleep on board his drifting yacht during a night time Force 10 gale was yesterday aquitted of posing a danger to shipping by being drunk in charge of a vessel (Shirley English writes).
John Smith, 38, was found slumped by the tiller of the 26ft Ceol Beag in the Sound of Raasay with a partially drunk bottle of wine beside him when lifeboat crew boarded his zig-zagging vessel on September 19 last year.
The yacht was in complete darkness with no navigation lights showing, Portree Sheriff Court in Skye was told yesterday.
Mr Smith was taken to Portree Harbour. He was then interviewed by police and declined a breath test.
He said he was killing time in the Sound before attending a piping recital in Portree, adding that a mix of medication had caused the incident. He was acquitted of culpable and reckless conduct by Sheriff Alexander Pollock, who said the Crown had not proven beyond a reasonable doubt that his yacht posed a danger.
