Sustained, yes only up the air intake. If its the same as my MY02 Legacy GTB then the intake is across the top of the radiator right at the front, in a perfect place to suck water in as you splash into something. There are a few extra cavities/airbox etc which will catch the water before it gets to the engine so you should be able to get through deeper stuff if its only a short splash.
The older Legacies sucked air from inside the guards so should be better in water - I've been through rivers with water over the bonnet in Subarus but only narrow ones, in and straight out the other side.

The intake is where you suggest yes. I gave it a shot in my 1999 Legacy. Place just outside Droitwich called Ombersley was flooded. The road was "guarded" by the local fire dept who advised me to go back but I was out of time and needed to chance it (in fact, only a wrecked/flooded car would have been a sufficient excuse for my lateness at the time). The water came up to the bottom of the headlights - I could see the light from them refracted as they became submerged from time to time. It got through though. The deep part of the flood was about 75 metres long - enough to put a decent amount of fear in me.
I was looking at my new Leggy. I think the air intake is in the grill, which means it's quite exposed. I don't recall where my previous Leggy's intake was but I might have been extremely lucky not to have shagged it good 'n' proper that night.

My first car was an old Subaru Leone which I managed to drown once - water level was about the bottom of the windows, I made it maybe 10-15m with about the same to go before it started to splutter and I turned it off to avoid hydraulic seizure.
Changed all oils/filters etc, took the seats and carpet out for a week to dry, blew about a bucket of water out of the exhaust when it first cranked over but still went as well as it ever did.
