I'm a consultant and I invoice weekty. In early December, I received an extra 2.5k on my weekly payment. I phoned the guy in payroll at my agency and he asked me to transfer it back to them. I can't do electronic transfers from my company account so told him to withhold it from my next invoice which he agreed to do.

He hasn't and I haven't reminded him. At what point should I tell him?

Quite fancy a new shotgun and £2.5k will do nicely! hehe

I'm assuimg that at some point they'll find the error but is there a time limit as to when they can claim it back?

What happens if I get a new contract with a new client this year and change agency? How can they go about getting it back?

Should I do the decent thing and send a cheque?

I'd say as I'd feel guilty having it TBH.

Havign said that I've been overpaid twice before as a yoof working as a christmas temp in boots. When I'd given them the £300 odd they counted it and told me to "get out of this room your not trusted to be in here" instead of a "thanks for being honest".

So the next year when they overpaid me again I kept quiet.

I dont think there is a legal limit. Changing agency wouldnt exonorate you from owing the company their money.

I think you know the answer to that wink Would you want someone to keep £2.5k of yours?

There's enough chancers in the world and not enough honest, decent people IMO.

get a named contact from the accounts dept of your agency, then send a chequeue; recorded delivery. you know they'll discover it soon enough.

they may not remember you sending it back, but they'll bloody well learn your name if you don't smile

noting: the first person to mention "credit crunch" in whatever text/ meaning, is going to get a swift kicking! hehe

This happened to me, except it was £5k or so.

Nobody noticed, then 6 months later I got a panicked call from the agency. I stalled them for about a month, then they sent a solicitor's letter demanding repayment. This annoyed me, so I then paid it off in 3 monthly instalments.

BUT i had no intention of using the agency again, so as others have said be careful who you annoy.

Ah well, it's earning interest at least...

Shame it was only £2.5k really...

I'm strongly considering just waiting until they get in touch - it's their fking mistake.

A company that i had worked for paid me a cheque for £1500 when they only owed me about £400. I banked it and forgot about it but months later at the end of the tax year their accountant called me to say that it looked as if they had overpaid me and could I check my accounts and get back to them.

I apologised for the error and sent them a cheque a few days later.
