I won something on ebay on the 28/12/08. I payed by paypal straight away and got confirmation from the seller that the payment was received, and the item was being posted.

He then emailed to tell me that his courier couldnt pick the parcel up until the 5/01/09. I wasnt too bothered so left it at that.

It still isnt here - I emailed him on monday morning to tell him it didnt arrive, and to ask if he had a tracking number etc. He replied within an hour to say he had posted it and he would check where it is and get back to me.

Its now Wednesday morning and still no contact from him.

So the question is, should I try contacting him again, or just pursue him through ebay/paypal for non delivery?

And if I do, what happens if the item arrives in the meantime?

Done, ive filed a claim with paypal.

I like giving people the benefit of the doubt but as it is I have given him a chance to sort things and he hasn't bothered communicating back with me.

If the item arrives in the meantime what should I do?

if it arrives, which i doubt, then you can cancel paypal action. but don't it if he gets in contact and swears on his mother's grave that he's sent it, 'cause once you cancel , you can't re-start a claim
