How do you find out if an "Incident" is on record?
Discussion
I need to know whether an incident that happened when I was 26 is recorded anywhere by the CRB.
I was not if I remember correctly arrested as such just asked to attend a station straight away (which I did) I was fingerprinted and interviewed, I do not think I was cautioned and certainly no further action was taken. I now have to declare any and every documented transgression in my past and don't know whether to mention this.
Who can I contact to find out?
Cheers Nick

Don't know the answer, but have a similar situation.
Was stopped for speeding in 1989 (approx 95-100mph) on my motorbike on the M4. Was sent a 'you must go to court' letter, but replied that the date was in the middle of my final exams at Uni. Was sent another court date but forgot to attend (too much celebrating after graduation!). Never heard a dicky bird since, but did move from student digs without a forwarding address...
Have been stopped quite a few times since - not for offences - and asked to produce documents at police station. No mention of it during these visits.
Any recourse I can expect?

You can apply to have a search done of you police records under the Data Protection Act. it used to just apply to computer records but I understand it also applies to paper records too, now. You need to ring up the relevant force for the form. You need a small fee (£10 when i did it), and a form of ID. ID needs to orginal doct (eg licence, passport ) or a "certified copy". I got the local police station to photocopy my licence, stamp the copy and sign it to verify. If you were interviewed at a station there should be a record of it, but an employer is only entitled to ask for any relevant convictions, I think, not all your records. Maybe the PH BiB can add further details?

yep, but if you're going for a job at the MOD they will route around in your past (and your family's) for a bit before granting you Security Clearance. The initial questionaire is hilarious in places, including such gems as: "Are you or have you ever been associated with any extremist or activist groups"
..only Pistonheads..
Matt.
Some employers insist you apply for record and have it sent to you. You then take UN-opened to the employer who then checks it over.
This is for some jobs that require security aspect, such as Security Guard or Contract Prison work, although they will check you out for the contract company before you are allowed to start onsite at Prisons.

you could ask one of the BIB on here to check you out![]()
It can take several weeks for your own check to come through
If that is possible it would be great, I imagine however that they would have to have a valid reason as in checking No Plates etc and so would be unable to do so.

They can ask all they want but you can lie through your teeth (MOD jobs and caring roles aside) because they can never find out the truth!
For my sins I have the role of Human Resources Director in my Company - as and when we need one as it were. I did recieve some training in the role briefly.
One of the questions we always ask, very politely and with apologies for having to ask it is "Do you have a Criminal Record?" To which the expected answer is "No".
We don't check. We don't care. The issue is that should anything untoward happen and it come to light the employee lied during the interview they can be summarily dismissed for dishonesty. This has, in my past, been very, very useful when someone whom we should have been able to trust turned out not to be trustworthy....
For this reason it is important to be absolutely honest - although if all you've got is a Drunk and Disorderly whilst a student this is not going to be a problem...
May as well explain why I need to know at the risk of some abuse, I have an interview with the Lord Chancellors Advisory Com to become a magistrate and trust me they will look at every incident on record!!
I merely need to know if this one thing is worth mentioning, apart from that I just have two Fixed Penalties which are no problem.
I think a postal request for disclosure will be too late for the interview (beginning of Nov).

heh, one of the questions on US immigration forms: "Have you ever comitted any crimes that you were not convicted or caught for?" ...
Perhaps asking the question again would prevent further terrorist attrocities ... rather like issuing ID cards will stop illegal immigration into the UK

I think the standard CRB disclosure only shows those cautions/convictions regarded as "current". The "Enhanced CRB Disclosure" required for certain reserved occupations including police, armed forces and various others is only available via those employers (although you do get a copy); these I believe include spent convictions also. Run of the mill minor motoring offences do not appear on either an Enhanced CRB Disclosure and I therefore assume a standard one also. They do not appear on PNC checks either as I believe only those more serious motoring offences known as "recordable offences" such as D/D and Causing Death by Dangerous Driving are noted. I speak from personal experience having had both PNC and enhanced CRB's done fairly recently.

You would be amazed, then, at the amount of digging that goes on when you apply for say a shotgun certificate.
Not that any of it counts, but they are out to get you for failure to disclose.
ANYTHING.

Preumably you could just copy your first post on this thread on to the form? Maybe with a few more details about why you were asked to go to the police station in the first place?
