IIRC from my old Criminal Law lectures, in this country at least and before the recent terrorist legislation, there had to be some degree of evidence that someone actually had the intention to carry out a criminal offence to be found guilty of attempting to commit it.
For example it is well known that there is an armoured van which traipses along a certain motorway from the Royal Mint to the BoE every so often. To plan how one could hijack this and steal away with the contents would not be a criminal offence (even if you were stupid enough to post you plan up on the net), but any action towards the commissioning of the offence (such as the purchase of a set of hydraulic rams) could be seen as sufficient evidence of intention to commit the offence.
I am more than happy to be corrected if the law has been changed in this area.

Apparently, if someone threatens to "off" Broooon the SAS turn up knocking on the door!!..... Then give you a helicopter trip to Downing Street and help distract the coppers on the gate!! 
After all the palava of the ceremony today, and all the hype about Obama, how stupid was that guy to post crap like that!!
On a slight tangent, it looks like "Dubbya" was the first President elected in a year ending in a zero that has left office without being assasinated or having an attempted assasination...
