I've looked a bit more closely at my summons and the "witness statement" from Herr Himmler's grandson.
The summons is dated 2 October, 3 days within the six-month time limit for laying charges. It is a computer-generated document. The letter from the CPS, however, which came with it, is signed and dated 20 October. Is there a possibility of arguing that the summons was "out of time" because it was not sent within 6 months of the date of the alleged offence?
Secondly, Herr Himmler Jnr's witness statement is not quite filled in correctly. Underneath the preamble (ie. statement of: ...., Occupation: Speed Reduction Officer) the first line reads:
"This statement (consisting of ... page(s) each signed by me) is true to the best of my knowledge and belief ...etc etc." No figure has been entered to say just how many pages the statement contains. Could a half-decent defence pick up on this fact? (eg. "well, Herr Himmler, how many pages were there? Might there have been another page that has not been submitted to this court that says "but I'm not sure that the accused was the driver at the time" or such like??")
Any advice would be appreciated !!!
