My other half has just been tranfered to a new company via tupe transfer. This has happened to her before so she is aware of the basics and how it works.

Slightly different this time in the fact that she is currently 22 weeks pregnant. Obviously this means maternity rights could change, but as yet this is unknown. Does anyone know if there are any special rights regarding maternity rights and tupe transfers.

This is the last thing she needs at the momment and its a bit of a worry. Any help or suggestions much appreciated.

I thought the whole point of TUPE is that she should get at least the same rights as she would have had at the previous company?

Yeah sorry. Obviously statutory maternity rights are the same. Its the maternity policy i.e. over and above statutory rights were worried about, things like rights to extended time off and pay during maternity leave.

That's what I mean - TUPE is supposed to ensure that she has the same rights she had before, doesn't it?

Under TUPE everything in an employees T&Cs should remain the same, with the exception of occupational pension schemes.

Thanks for the replies. We knew about the pensions scheme, but she has been told that the maternity benefits are treated in the same way as the pension. Doesn't sound right to me, I would have thought maternity benefits would be treated the same as pay and working hours etc...
