I need a bit of decent advice here on law works with regard to parking tickets. It's a bit complicated bit bear with me

Son-in law drives a car which is provided via my wife’s company (she works for a car manufacturer so they are a perk of the job). A few days ago Denise (my wife) received a summons to appear in court regarding an unpaid ticket. It was served at her place of work because that's the car’s registered address, in her name.

So:-

1) Son-in-law maintains he never saw the original ticket, and considering it was only for £15 if paid within 14 days and ii) he's hardly likely to piss Denise of seeing as he gets a cheap car from her, we believe him. We assume it was ripped off by some kids.

2) To compound the issue Denise didn't received a written reminder/warning, although RBWM Council maintain it was sent. It's a big firm where she works and they have a post person so she knows is 99% certain it was never received.

3) Suddenly a summons appears requesting £100 or a court appearance!

My reaction is to say stuff it because they cannot prove they wrote to her.

The Ticket is valid (a copy was provided with the summons) and Son-in-law was in the car park at the time/date. A photo copy of an un-signed reminder letter is also provided as evidence with the summons but frankly this could have been run off the laser printer yesterday!

Thoughts/comments anyone? Rich...

Well I wouldn't pay. I'd be tempted to go to court and plead that you knew nothing about it and the council haven't met with their responsibilities in informing you. I'd also look at the scene of the offence to see if the ticket was issued correctly but don't know if that will help at this late stage or not. If you go to the council and tell them your thoughts and intentions you may get some joy but that's a long shot. I've called their bluff and at the arbitration stage they withdrew but they pursued it all the way there!
