Phone company complaint what to do

To cut a long story short I signed up for new phone provider. Do I want to be in the telephone book? No I certainly do not, ex directory for me please.

They have now printed my new phone number, address etc... in the god damn phone book and are ignoring my complaints and demands for compensation.

Surley this is a massive breach of my rights publishing my details when I have asked them not to and they have confirmed my request to be ex directory.

Any advice?

They've bre4ached the Data Protection Act. I seem to remember that you can sue for a standard £1000 per breach, but I have no idea where I saw that. Maybe write to their Data Protection Officer and ask what they plan to do?

Ignore the "sue" bit above. You must be damaged first.

Its actually the post office trying to do something they are not good at (offering phone rental) should have stuck to delivering the post.

Well, you can issue a Section 10 notice to the Data Controller. Advise them that they have breeched the data protection act (1998) and they are to stop handing out your details Immediately. This *should* mena that they will have to destroy any copies that they still have and will be delivering.

Unfortunately not a lot you can do. You can report them to the Information Commissioner. He has the power to fine them, but it will only be for a few £100. Pathetic actually.

Perfect. You can't sue them because if you do, they'll say exactly that. And you'll lose. And you'll have to pay all the costs.

If you want to be a real bd about it (and I would) go with the Section 10. That would mean that they would have to stop processing ALL you details. Which also means that you'll obviously have to leave them. But ensure that they destroy all data they hold on you. This would include all their phonebooks then.

You may have to take them to court, but as far as I can see, they would have to comply with a section 10.

Its more the principal of the matter. Why ask me and then print it?. The next person they do it to could be hiding from someone, an ex whos aggressive for example. If someone doesn't make an example of them they will continue doing it.
