I bought a CD player for the Pug in Halfords 2 weeks ago and its developed an intermittant fault, CD's are played distorted with lots of white noise. It wouldnt work for the hours drive home last night or first thing this morning but was bloody fine when I got to the store today.

They won't refund my money or allow me to exchange it unless they see it playing badly! The only option they would give me is to send it away.

The receipt has an attachement:

"If your purchase develops a fault within 30 days return it to any store with this certificate. After 30 days returned goods will be sent away for repair and normally returned within 7 days"

Can I reject this item under the Sale of Goods Act?

I work over an hour away and self employed so I can't take time off chasing to Halfords everytime it cocks up.

Take it out, pack it up and say you want a refund. They can not refuse under consumer acts. Especially if its broken and its not fit for purpose.

Wrong, if its faulty you have to offer them the chance to repair it.

Can you remove cd player? if so take it back to Halfords, stand at till, speak to manager, produce reciept and ask for exchange/refund.

If you cant remove it yourself, take car to Halfords, take box in, do above.

If no joy, get straight onto the phone to their customer services (office hrs only) and point out you are in store and want it replacing/refunding immediately.

Halfords do (or did) use AEL for repairs, and they would take up to two weeks to return, but were usually fixed. I would have swapped the unit straight away for you when i used to work there - no point upsetting a customer who will ask for a refund if not sorted, and you are still left with a faulty unit.

SoGA says:

Consumer requires repair or replacement
The seller must repair or replace the goods within a reasonable amount of time, incuring all costs necessary to perform this task.[18] This cannot be required if it is impossible or disproportionate in consideration of other available remedies.[19]
Consumer requires reduction or rescission
This is only available where repair or replacement is impossible or the seller is taking an unreasonable amount of time to perform these requirements. Any reimbursement must take into account any use that the buyer has had out of the goods.[20]

Repair OR replacement, they wouldn't change it.

I told them I'd even pay more to have a better CD player because this is useless, but they wouldnt do that either.

I should be able to get it out OK, exactly a bit of decent customer service would have been great, I wasn't being unreasonable or stroppy (to start with) I have a trade card and have and was planning to spend a fortune for the Oz trip! I even have my own sets of Halfords Pro tools FFS!

Customer services
Fax: 01527 513529
Switchboard: 01527 517601

remember how disappointed you feel about the way you have been treated, if you let your fella go in they would have sorted it for you, its cos you're a girl blah blah blah with the customer services staff. Used to get them bending over backwards to help customers, no matter if they were right or wrong ( was 5yrs ago mind, but they havent changed)

Thanks very much! I'll give them a bell!

From their own website....

Halfords Returns Policy
We hope that you will be happy with your Halfords purchase. However if you need to return any item we will happily refund or exchange it, provided it is within 28 days of delivery, in its original packaging and with proof of purchase.

Unwanted Goods
If you decide that you do not want any item that we have delivered, we are happy to offer you an exchange or refund within 28 days of delivery. Any item must be returned unused in their original packaging along with the original packing note and copy invoice (as proof of purchase).

DVD's, memory cards and software can only be exchanged if faulty or if returned unused with the original seal and wrapping intact. Personalised products and made-to-order products cannot be returned unless faulty.

Faulty Goods
If you purchase a product online which is found to be faulty we will (depending on the item) supply a replacement product, arrange for a repair or give you a refund of the purchase price as appropriate. Should a fault occur after the initial 28 days, we will resolve your concern in accordance with current consumer protection legislation.

Just spoken to Lisa at CS, she's going to ring the store and tell them they should have at least replaced it, seeing as its within 28 days.

Fingers crossed for a call back soon.

Well I have taken things back and demanded for a refund. Has never failed yet and that includes Halfords, Comet, John Lewis and a small PC company. All items a few weeks old and broken.

If they insist it must be broken before they'll do anything, I'd make certain that it's broken....ifyouknowwaddamean.

Take it back, odds are someone else will be on the desk this time and maybe more friendly.

Took 2 goes before I got the stereo I wanted out of Halfords. Both times swapping it was no problem.

Failing that, I'd be tempted to try another branch so long as you have the receipt.

All sorted, the manager must have had a bking, he wouldnt speak to me this morning just sent his minion back to say unless it was faulty right now they wouldnt change it.

Just now he couldnt have been more helpful, offered a refund which I was going to take then he said he could knock a bit off a new unit.
So I got a nice Sony one, £149.99 with £20 off on special offer and he knocked off the £20 I'd paid to have the original fitted.

Yay, I like getting my own way! biggrin
