Paypal / Bailifs letter

4 Months ago I sold some parts on Ebay. An Overseas buyerbought one he paid up except for the postage and all was well unti a Month after. The buyer logged a claim saying that he did not receive the goods ( suprise suprise)
So I went through all of the right channels via ebay and passed over the email corrospondance ets but I had no reciept of postage, why would I after a Month so Paypal sided with him and demanded £35 from me ....

I called them and no luck so today I have received a letter from a debt collection agency requiring the money. Now I know it's only £35 but it's the point that's pissing me off.

Is there anything I can do???? or do I cough up the wedge and take it on the chin

I have stopped excepting Paypal for this exact reason.

The PayPal user agreement says that you must always send goods through properly traceable means - something you can get a signature for, basically. If you don't do that, or if you throw it away, or otherwise can't prove you posted it, then they can take their money back.

It's a hard lesson, but recorded delivery/proof of delivery is there to protect the seller. Never offer any other service.

This is one of those thing that makes you think "after all the stories, why would you not send via tracable means, or not keep the proof?"... Paypal, and ebay tells you all of this.

Many, many sellers seem to think that P&P is somehow the responsibility of the buyer ("if you don't pay extra for insured post, I can't be responsible if it doesn't get to you" for instance). It isn't. The deal is a mail-order one (much of the time) - the transaction isn't complete until the goods are delivered by the seller to the buyer.

The only way to prove receipt is, err, to prove receipt. Think about it from the other side: if you ordered something which didn't turn up, would you be happy with a seller who said "sorry mate, tough, just trust me - I did send it - but I can't prove it"?

Exactly... Whilst you have no proof you didn't send it, you also have no proof it was received... It is your head on the block, not his, so, always send with a signature required. it;s not much more expensive.

I've experienced this nightmare as an Ebay buyer. Never got the goods I purchased from a seller (Ebay shop) in America (who suddenly disappeared with loads of similar complaints). Paypal said they had a refund, but I never recieved it. Paypal stinks. Sorry, but it really does. I don't know of anyone who hasn't got a grievance with "safe shopping / selling" Paypal. Ebay need to go with someone else, or at least give an option to do so. Hope your issue works out!

Untilthey have a court judgement, bailiffs have no authority. They are just acting as debt collectors.

Thanks for the stories guy's but is it worth trying to contest it with the collection people as I haven't made contact with them yet?

I know the buyer received the goods becouse he emailed me saying that the part took to long to arrive and could he send it back as it was no longer required all of which I passed to Paypal...

E-Bay own Paypal,hence it's pretty screwed down and watertight.

Sounds like you have evidence that the goods were in fact received then. Tell the bailiffs to f off and you will not entertain any further correspondence with them.

Ive had this happen loads to me when i used to sell a lot of stuff on ebay. Was only for less than £10 each time but i just paid it. This it was about 6 times it happened.

All i did was take a note of the twanger at the other ends user ID when they put anything up for sale win the item and do the same to them see how they like it ! I no its not correct but why should the seller always be the one to loose out. Paypal or Ebay wont do a thing to help you out.

Same here.

I sold my winter wheels via ebay. 4 months later the buyer popped up saying they were buckled, which, when i sold them they were not. Unluckily for him ebay only gives 90 days for disputes, so i told him to poke it.

He then got his 'solicitor' to threaten me. The solicitor had a hotmail address that referenced Hull City FC. Told him to poke it as well
