NIP Arrived today

Hi there
Ok, the NIP for the speed offence mentioned a couple of days ago arrived at my home today, However, there is nothing on the NIP about what speed I was doing, Is there any way I can find this out without having to give the details of the driver first?

First things first: do you know with 100% certainty who was driving the vehicle at the time of the alleged offence?
If not, ask politely for the photographic evidence, maybe it can help re-jig your memory (then again maybe not, these photos are for vehicle identification, not driver!)

A friend received two NIPS, both for under 20mph over the limit - they said the speed and asked who was driving. When he replied stating he was the driver, they sent him the offer of a fixed penalty.
If theyre not telling you the speed, id guess that means they're going to take you to court??

"A person required to give information has no right to ask for information about the alleged offence before complying with the requirements"
and YES you can be charged with failing to provide details of the driver.

Any BiB able to clarify this please, Also, whats the best way to process now, Do I send back the NIP without disclosing the driver in order to see the photo or do I take this like a man and play Russion roulette and admit to the offence and then hope for the best?
also, If I were caught (which I clearly have, I'm just not sure of the final speed reading) doing +-100mph what ban/fine am I facing?
I would appreciate any advice

1) Was the NIP sent second class post? If so, retain the envelope; you're off.
2) The NIP should give the time and the place. If it doesn't, retain it; you're off.
3) It should also specify the "nature" of the offence. How specific that means would ultimately be up to a court to decide, however giving no indication at all is arguably insufficient. More practically, I suggest that you use that as a lever with the scammers to try and get an indication out of them what the alleged speed is. Having ascertained that, you are in a better position to decide what to do.

Whilst this ever helpful chap has pointed the fact that you have "no right" to find out details about the alleged offence you can however easily find them out. Just ring the issuing office of the ticket and give them the reference no, saying youve received and NIP and you want some further details, they'll tell you. They told me when i received a similar NIP about six wks ago.......and it may well mean you were allegedly snapped doing a large amount over the limit.....my car was allegedly caught going quite fast & this qualilfies for a free visit to court without any FPN offers apparently.
Always nice to know youve got a moralist in 318ti to point out that you obviously are a criminal and you dont deserve to know the details of the offence that they are sneakily trying to get you confess to.
how dare you think that you may have rights..... personally i dont know why speeders arent charged with attempted murder.... clearly were all 1 step away from killing someone when flooring it on a clear rd on a clear day in the dry and with good visibility and as, in such circumstances we choose to speed deliberately cos we enjoy driving clearly the "intent" to enjoy driving = criminal intent and therefore we should all be charged locked up and sent to prison for years, and then of course youd see crime plummet. its all caused by speeders.
By the way 318ti - if sitting by the side of the road photgraphing no plates is such a great way to catch crims.....why do the crime figures keep spiralling up along with the issue of speeding tickets? wouldnt you have expected an inverse correlation between the no's if sitting on their fat arses with a vid screen was so useful in fighting crime?
Richard ring them up & just give the reference no, dont make any comment on who was drving & dont reaveal your name, lie about who you are if necess or say no comment. take your NIP form to your solicitor and get them to fill it out & return it for you. job done. then wait for the nasty letters to follow from 318ti's friends.....

Friendly chap in the video dept answers, told him I wanted to check it was me can I come and have a look?, he says hold on I'll get the video, call me back in ten......
10 mins later, I call back, he's looking at the video as we speak (I'd been lasered), he said the plate was clear & so was the driver & I was obviouly not looking at the camera at the time! something about being on the phone - Doh. Fair cop he says difficult one to get out of.
Anyway I was welcome to come down and have look, just had to book a time. Anyway never did, I just accepted it after that.
That Notorious dual carraiageway out of Farnborough thats a 30 but it's not obvious. Got another 3 two weeks later being really daft down the A303 having spent a week in Germany.
I'm not sure they're so keen to let you have a look nowadays though.

I sent a letter (not signed) requesting photgraphic evidence. My reason was to identify the driver. A couple of days later I duly received them in the post, cannot identify who was driving from them. Wrote back stating from the evidence I could not identify the driver so wrote and told them so. Received a letter back saying they are going to prosecute for not telling them who the driver was. Now I've written back stating that I spilt coffee on the NIP and can they send another. If they send one I will consult my solicitor on what to do next. This is fun! I think I might put two names on the NIP see what response I get.
