Since I am usually in the TVR forum I thought i might ask here for some help..
My little sister purchased a new 58 plate focus convertible and has had nothing but problems with it in the 5 months of ownership, in short the dealer, who shall obviously remain namless, has had the vehicle for 13 weeks out of those 5 months, and has taken it back several times because of these faults, the fault with the windows has never been rectified!
This has all ended up with my sister being offered a new focus convertible on an 09 plate, after she threatened to go public with the way she has been treated and the way they have dealt with the problems.
The new car has been picked up by her today and...... wait fot it.......
It bloody well leaks !!!
She has come to the end of her tether, and between the phone calls and stress of not having a reliable car, and the fact that she has STILL been paying the finance (along with the s
tty atitude of the dealer) she has deciceded that she no longer wants the car.
does anyone know how she legaly stands with simply giving the car back??

I should think there's 2 ways that this could be viewed.
- Firstly that the dealer has done the right thing and bought back the original car (did you get the full amount back/straight swap for the new car? Or did you take a small hit on the old car (on the basis that you still had a few weeks use?).
It could therefore be viewed that you should give the dealer the opportunity to fix the new car, and only if this car has similar levels of issues, should you be able to get them to buyback the car.
OR
- Quite simply, you're entitled to give the brand new car back on the basis of the previous car/experience and simply walk away and take your business elsewhere.
If you've got the new 09 reg car through the same dealer, and you're not confident in the dealer themselves then I would say go for the second option. Walk away, and either change car choice or change dealer. Depends how much you want a Focus I guess, or whether there's anything else in the price range that you'd consider?

Thanks for the replys, I have posted similar in the ford forum, but as im resident here I thought I would ask.
I think it got to the point this afternoon, after taking another afternoon off to pick up the car, that my sis has got to boiling point (not funny seeing as she was once a bouncer!!) and she no longer wants the vehicle.
The dealers had done a straight swap for the new car, and have put 18s on it rather than the 17s previously, but this is not enough to sate her, especially as the roof leaked 2 hours after being picked up.
Also, after a bit of digging, i have also found the info about the constant leaks on the cabriolet, and we all thought it was only TVRs!!
perhaps the finance company will be able to help, its not an avenue thats been explored yet, but ill get her to call them tomorrow.

if you have it on any kind of finance,phone the finance company up and explain what has happened and that you are still not happy.they have to do something about it as you are covered under the consumer credit act. they have to oblige,either getting it fixed or giving you your money back.
