Just flashed twice by a Gatso doing about 55 in a 30.
I was showing off my radar detector to a mate and I'd just muted the dam thing and did not see it telling me the Gatso was loaded !!! How stupid Am I ??? Yes VERY STUPID !!

So I KNOW this has been asked a million ( sorry ) times but what's the score with a NIP ?? Send it back unsigned ?? Say it was me Aunty in Brazil ? Say I never got it ? Say it breaches my human rights ?

Any advice appreciated. I'd like to try and keep my clean licence..... ANY advice much appreciated

Doesn't seem to be much you can do I'm afraid. You were speeding in a Gatso zone and you were flashed. Just bad luck mate.

Yes Lazy of me not to look. So I send it back unsigned registered post. Do I really use a type writer ?? Bit Obvious is it not ?? Guess not signing it is too..... Then just Ignore all correspondance till I get a summons then request evidence ( Gatso picture of rear number plate x2 ).. then say they have no evidence ? Is that right outlaw ?? Bit Scary ... ? Any advice greatly appreciated...

No offence, but why not just sign it and take your 3 points and fine?

I hate cameras as much as anybody when people get flashed for doing 80 on the motorway, but doing 55 in a 30 - that's pushing it a bit isn't it!?

What's the point in naming yourself as the driver and not signing? As the registered keeper you've still named the driver at the time of the (alleged) offence

And your auntie from Brazil would have left traces of entering the UK. Traces that are not there.

The current 'thought' is that you get your spouse or solicitor to complete the form and return it unsigned.

This fulfils the requirement to return the driver details, cannot be construed as a confession since you neither completed nor signed it, and your spouse/solicitor cannot be compelled to give evidence against you.

(Yorke case).

agree - 55 in a 30 is a tad high . I'm sure you'll know better next time. Just put it down to experience.

HAs anyone actually thought that the 30 limit matey got caught in might have been a 60 once upon a time? without going into specifics that would upset the growing number of Blairite-PC infiltrators of this fantastic website, I have done considerably more than 55 in so called 30 zone, and felt justified doing so. Yeah have a laugh at Stupid Twit, but also try and sympathise. Maybe even help? right, Twit.. not signing is a top idea, and it works. You need to keep your cool though.

Thanks HertsBiker for the Support - the Road is actually a wide dual carridgeway with central reservation. People are begining to buy the crap that Its only speed that kills, they seem to forget that sometimes 70 in 30 is very safe and other times where 25 in a 30 is UNsafe.

So ! Not signing the NIP - what do you mean Herts keep your cool ??? Not reply to all the threatening crap they send in the post till I get the summonds then I send a similar copy of the letter from Super Steve, thanks Gopher ( if that's OK with him )

Any Views anyone ?

I think the way Steve has handled things will see you through, however be aware that things may have changed slightly since his case (this you can see from the thread link I posted), however as outlaw suggests no - one,it appears, has been convicted with an unsigned nip, and I think in all likely-hood an un-signed nip is not going to be convicted, but you need balls if you are going to fight it.

If you think that you were driving safely and "could stop in the distance you can see to be clear on your own side of the road" then fight it.

Thanks Rospa, it was a clear Dual carriage there where no cars ahead.

Anyway what really I want to know is are people managing to get a result by not signing the NIP ??
Please ( I wish I hadn't used a stupid name ) Can we be constructive here - we are all, unless we avoid all speed traps indefinitely, gonna get caught eventually by a camera, talivan or something. Some people have already managed to uphold common sense - and avoid points and a fine, if we can put together as much info as possible on how to prove we won't roll over to government intrusion, and surveillance in our lives, we might avoid cameras in our homes, work places and bedrooms!
