Seems to be the in thing these days to try and say people were racing. How many people when alongside a vehicle they were overtaking would drop back if it speeded up? It also takes two to race so I take it the other driver was prosecuted as well?

The Sheriff tried arguing that he was then in effect racing the car which could be considered dangerous driving.

If the sheriff thought that, he would have been convicted. The sheriff is the judge.

In that case I should be done done for "Racing" nearly every week then. Abslolute B******KS

The number of idiots who put there foot down when you overtake them is ridiculous, especially if you indicate your intentions in advance!.

Hence I very rarely let the person in front know I'm about to overtake them, cars behind yes if need be. Bloody numpties round are way try wandering about the road to stop you passing them!. Old gits in rovers too not young boy racers. At always on nice safe bits of road too.

My wife meets the same 40mph'er several days a week on her way to work, I'll see if I can get the video in the car for next time just so you can all see what he does.

Tony what's your view on this?

Should we write to this judge?

Just my thoughts.

Journalist? You're a bit more than that, aren't you?

From rule 139

"move quickly past the vehicle you are overtaking, once you have started to overtake. Allow plenty of room. Move back to the left as soon as you can but do not cut in"

Rule 144 highway code.

"Being overtaken. If a driver is trying to overtake you, maintain a steady course and speed, slowing down if necessary to let the vehicle pass. Never obstruct drivers who wish to pass. Speeding up or driving unpredictably while someone is overtaking you is dangerous. Drop back to maintain a two-second gap if someone overtakes and pulls into the gap in front of you."

I wouldn't have down him but I would have done the other driver if he had sped up

Sorry, I assumed that it was a quote from another source.

I suppose next time, he'll take the sound advice implied by the court and not accelerate next time he's alongside a car and therefore stay in the oncoming lane for a bit longer than he could. Still, if we had speed control devices attached, we'd have no choice.

So, a speeding offence by the overtaker, bUT a speeding AND dangerous driving offence by the overtakee. I wonder whether the overtakee was prosecuted? And if not, why not? - Streaky

Old Timer said in court, "I really need to keep my licence as I cannot manage up the long hill to my house without a vehicle and I promise to sell my bike immediately". Judge looked over his spectacles and said "very sprightly looking pensioner to my mind".
On leaving court, old timer (my uncle), went to Perth and sold his bike, but immediately bought a new Z1000!
ps he also owns a WRX Impreza and an S4

The sheriff is a pillock.

Racing infers intent on both sides....a competition.

In these circumstances, not so.

If the sheriff can't see that, he's not fit to sit.

I'm saying that the elderly have a lot to answer for regarding road safety...and it's not the young and the driver of the powerful car that does everything wrong.............

Im afraid that this speedy pensioner is the exception.

Most of the silvertops I see (especially round here in Devon) are absolutly terrifying! Saw one on the main a30 Duel NSL dead striaght road doing 30MPH! Cars were having to take serious evasive manuvuores!

"safety" camrea van down the road didnt seem to bothered...

please excuse spelling, am on very strong painkillers which dont let me think straight...

We agree on the subject.....

However, not quite sure what the camera van operative is supposed to do in those circumstances...other than come under more critisism....

Hope your painkillers are working mate...

Codine Phosphate - ooooo

The camera van has recording equipment does it not? Surely it can record the vehicle doing 30 on a NSL 70 and it would CERTAINLY have caught the cars having to take evasive manuvoures coming over the brow of the hill...

Shouldnt something moving that slow in those conditions need orange flashing lights by law just out of interest?

Maybe it could become a pensioner accessory...
