Right, here goes. The Day of Judgement has come. Suffice to say that I shall put up a spirited defence !!!

I have been studying recent case law this evening, and I wonder if anyone knows what the current position is regarding Mawdesley's retrial? Both safespeed and pepipoo are silent on the matter.

Has the retrial happened yet? Has it been given a date? Even worse, has it happened and new case law has been handed down that I don't know about ???!! (Then again, if I don't know, possibly the prosecution doesn't know either !!

Any current information would be much appreciated.

AIUI,
1) Mawdesley has decided to fold.
2) He has not been to court yet.
I have no idea if he has got a trial date yet.
My understanding is not definitive.

Perhaps he's not been up again because the CPS could hardly not cite Y&M in his case, as the magistrates would know about it anyway.

Defence, "No admissable evidence, the form is not signed."
Prosecution, "Uh, O.K. then."
Magistrates, "But what about CC Cheshire / DPP -v- Yorke and Maudesley, can't the form be admitted as a confession?"
Prosecution, "Well, err, uhmmm, not that simple.., err.., PACE."
