Guy on the VX owners club wanted an opinion on this...

"Earlier this morning on the way to work (07.45), was having a bit of a razz with a Passat v6 who cut me up at a roundabout...sat in a line of traffic travelling down a dual carriageway at about a ton.

Next thing, I look in my mirror and see a Police Focus sitting right on my tail so of course I slow down and start driving all sensibly. He follows me for about 3 miles and then pulls me over as we near a suitable place to park up.
He proceeds to tell me that driving at approx 110 is not sensible (that's a given although I question whether it was 110...he said his focus runs out of puff at that speed so it must have been more) and that racing a Passat is also not sensible (couldn't agree more)..I was not racing him, I protested, merely sitting behind him in a line of traffic etc..
He then says he will recommend me for prosecution (as well as the other car..he had written down their index number too)
How does that work?...he had no speeding equipment (so how can he prove I was speeding) and was driving alone therefore surely it's his word vs mine if it goes to court?
I can understand getting a speeding ticket (because I was speeding) plus fixed penalty fine but prosecuted...sounds a bit more serious. "

Any thoughts on what will happen?? Could he get done for driving w/o due care or racing(which means no insurance??)

You certainly could be prosecuted for the mentioned offences.
If the speedo in the Police car is not a calibrated one then it will be taken to their local Traffic garage and put on a rolling road or ran alongside a Trafpol car to ascertain how accurate the speedo is.

Theres not reallt too much difference between 100 and 110 in terms of prosecution, only the fine will differ.

Edited to say that over 96mph is a prosecution and not an FPNE.

I was "caught" doing 1** on the M**, by a single copper. After giving me a "stern telling off" and issuing a ticket I was obviously worried. Never heard any more from them (It was 4 years ago). I assume this was as it would be his word against mine.

p.s. It was a clear road, and the cop car was, using his words, off the speedo to catch me up :lol:

If he gave you a ticket then in most probability he didnt submit the evidence side or he lost it etc etc. This does happen from time to time.
You can rest assured that he wouldnt be bothered about being a lone Policeman because when we do tickets we often work alone. I guess that its no different to us prosecuting someone for speeding from a Police Bike.They dont have any speed detection devices (only a calibrated speedo which is then checked on rollers etc) and only have a rider etc.

So he could be done for any of the offences??

due care?
racing?
speeding?

Ouch! Which do you recon most likely??

He should have been told at the time exactly what offences he was being reported for. Without seeing all the evidence its only a guessing game sadly.
