Who owns the fence ??

Yep - another fence question.

If a property backs onto the side of another property (both properties a couple of houses in from a corner of a road), who is responsible for the fence at then end of the garden if it also forms part of the side fence of the other property ?

I know this should normally be sorted out amicably between the two parties but life ain't always that easy/simple

It will say on your deeds, I own my back wall and my left fence around my garden. Neighbor is responsible for my right side fence.

Check it out on your deeds, its the only way to tell.

I've heard that the property whose side the posts are on is the one responsible for its upkeep

Having previously been married to an Estate Agent (not to get mixed up with property shop) I'm pretty sure it used to be your fence to the left when viewing the property from the road/front & fences that back on to another property to the rear alternate every other.

ETA oops - ommited to mention which fence hehehehe

Side of the posts or left or right boundary have nothing to do with it. As said previously, the Deeds are the only way to know for sure. If it isn't shown on the deeds (or either party) then it is whatever you argue/agree between you.

Should be the back and your left side belongs to you unless the deeds say something different!

You CANNOT make any assumptions about whose fence is whose without checking the deeds. They will have a title plan which will have a little T mark on the fence line indicating responsibility.

You should also be carful not to assumme that the fence is the boudary line. It usually is, but isn't always.

I know in our current place it's not clear, but when we needed to do fence work we all chipped in to get it replaced. In the house we've just bought, it actually states that everyone is responsible for the boundaries jointly, so here's hoping the neighbours are nice!
