Hi All,

How would you go about claiming a strip of land as yours and registering it with the land registry? The scenario is a strip of land that was presumed "belongs" to the house (it is effectively landlocked by the property) and has done so for the last 34 years does not show on the land registry website as belonging to the property and I cannot find out who if anyone the land did / does belong to if it was not the previous owner (deceased). There is a defined boundary of which the property is on the "inside" of but there is no documentation to prove the strip of land belongs to the house.

If someone comes forward to say its theirs what rights to access would they have as like I say it is impossible to access without entering onto the property?

I did enquire with a solicitor but got the "12 years" and if no one disputes put a claim in but I can't say I would stay in the property for 12 years and it makes things tricky to sell on.

Any ideas ?

If it is 'landlocked' then can you not declare that it has had the 12 years already?

You mention 34 years?

What do your deeds show? Worth checking the actual paper/parchment copies to see if there is any mention of it.

The deeds are lost. The previous owner built the house on the land 34 years but he had lived on the site all his life (he was 72 when he died suddenly thats why his affairs are in a mess). I thought any sucessive owner must have "owned" the land without it being contested for 12 complete years before you can claim it as yours or is there a way round it.
