I recently purchased 2 cd players ... cd decks in fact, on thursday.

One of them makes a horrible noise when playing a cd. The other doesn't.

Now can I ask for a refund as the good is faulty? And seeing as there are two of them is he only obliged to refund me one, seeing as you need a pair?

Why can't he just swap the CD player for one that works?

He should replace what ever he needs to so you have 2 working decks. If it is a set, then he may want both back to return to the supplier.

Call him and ask if the best option though.

He doesnt have one.

I should also note that on his website, in the T&C's it states a return to base warranty?

if bought as a pair, then yes, if they are available seperately then no, just the one that is not working should be replaced/refunded as the other one is ok.

You should still be able to return it if it was faulty at first use. Goods must be of merchantable quality. And if sold as a pair and not available singly elsewhere you should be able to return both.

Problem is, you can buy them singularly (sp.) but without one you couldn't do much mixing!

So what is the issue with buying a singular one or have you decided that you dont want the whole package?

Im not up to scratch on the sale of good acts, but if goes faulty within 28 days arent you entitled to a refund or replacement. If he cant provide a replacement, get a refund and buy it elsewhere. Its not like there arent plenty of places selling cdj's.

You need 2 to mix songs

You can purchase 1 if you want (Unsure why you would) but I purchased two for X amount of pounds.

If it doesnt work I would like to return both for a refund as he doesnt have anymore.

I do need the two but want a refund on both if its broke within a few days

Fault within 7 days, he's obliged to give a replacement or full refund.

As the intended purpose was to mix songs, I'd take both back and ask for a full refund.

If there's a risk of panic, I suggest you get clear in your mind what you intend saying - did you buy these players on a credit card by the way?

"I would like a refund please on the basis that the system I bought is unfit for purpose - one of the players is not working."

That should be the end of it, you are entitled to a refund. The word 'system' is fairly key, you bought a pair of decks to mix with, it is no longer a pair, one is dead and is pining for the fjords.

I think (but am not completely sure) that you could return these goods, ask for a receipt (which you could prepare/type up beforehand and have them sign), then take this up with your credit card company explaining that the goods have been returned to the shop but that they have refused a refund.

You could also mention that you have spoken with Trading Standards 'just to check on your rights under the Consumer Legislation Act'. Under the Act you are entitled to expect that any goods you buy from a trader are fit for any particular purpose made known to the seller.

Not purchased on CC.

I will go in there and say that I have spoken to trading standards and I am entitled to a full refund due to the goods being faulty within 7 days?

Any good?
