Does any one know which part of the law (if any) applies to a borough council to excuse them from a 'taking without the owner's consent' type complaint if your vehicle is impounded (i.e lifted/towed)?

I can see there may be several pieces of small print allowing them to do this, although I am more concerned with the fact that they don't seem to have any legal requirement to inform the owner of the car (or indeed let the police register the removal on their PNC - police national computeer). If the owner is not informed and the police have no record, then the first guess is to register the vehicle stolen. It can take a couple of days sometimes to track down a vehicle, by which time your friendly council has already been making a tenner a day. Although they legally have a duty of care over vehicles in their posession, this seldom seems to be excercised! I recently collected my car (from a dimly lit compound) only to find it was scratched down both sides when viewed in daylight. I have no proof it was damaged whilst in their care however.

I need a way to get back at the w*nkers.....

If it was parked illegaly, causing an obstruction or presenting a hazard on the road then I suspect you won't have a leg to stand on. If it was dragged out of your driveway then you probably have a good case.
