It has become common practice for companies and organisations to run photographic competitions for the purpose of harvesting large volumes of photographs from entrants which can then be used by the competition owner and/or sponsors at no cost. These competitions rely on 1) people not reading the terms and conditions, 2) the t&c's being difficult to locate and/or 3) the wording of the t&c's being difficult to understand.

The property being harvested from vast numbers of photographers (mainly consumers) is of great value to these companies who grant themselves the right to use the images in marketing campaigns and advertising, use on products and packaging and even in some cases resale and syndication.

We call on the Prime Minister to look at this issue during the Government's current review of intellectual property law, and to examine the 'Artists Bill of Rights' promoted by the photographic organisation 'Pro-Imaging' which calls for only limited rights (such as the right to use the images to promote the competition etc) to be taken by competition organisers.

IMHO If you're not sure what they're going to do with your image, or handing over full usage rights bothers you don't enter. I'd rather the government spent time looking over things that I can't control by not entering, like taxes and inconsistencies within the road laws.

I'm on your side, but I think there will still be millions of keen amateurs with day-jobs only too happy to give images away for free in return for the kudos of seeing their photo on a front cover, rights or no rights. (If photography was not my living I'd probably be one of them!)

The petition could've been more succinctly worded - "We the undersigned petition the Prime Minister to make sure that we don't have to actually read some text and decide if we're happy with the content".

Possible similar petitions might include the following:

"We the undersigned petition the Prime Minister to require shower manufacturers to include a technician with each shower sold to ensure the water is never too hot."

"We the undersigned petition the Prime Minister to come to our house and make sure we've not left the fridge door open by mistake."

I'm sure that the goverment are quite able to find both the time & resources to look into all the petitioned grievances that land at their door. thumbup

The point it's trying to make is that whomever wrote it wants to abdicate their own responsibility for reading the terms and conditions of a contract and deciding on whether or not they're willing to accept them, and wants the government to take on that responsibility for them instead. It's pathetic!

If you don't want to read the terms and conditions in a contract before you sign up to it, then that's fine, but don't go crying to mummy afterwards.

yes

it's a very unwisely worded petition as it just stinks of laziness and people screaming "it's not fair".

What they should have done was start a petition specifically noting requirements to the intellectual property laws alone.

We're sick of the nanny state and this is asking the government to nanny us some more.

If people are too lazy or stupid to read the terms of a competition and decide whether they're willing to accept them, then they either shouldn't enter competitions full stop, or they should accept the consequences of their actions and not whine about it, not go whimpering to the government complaining that it's not fair!

It's people not analysing everything and just fking signing it that causes this whole issue in the first place! If a few more people analysed things before they signed them, then they wouldn't need the government to protect them from their own stupidity.

Why would I sign something I feel is stupid?

This is either 1 of 2 things:

1) Someone too dumb to realise the obvious implications of entering such a competition, and I'm sick of this country catering for the lowest IQ possible.

or, even worse possibly:

2) A pro tog trying to protect his income by "cleverly" wording something that should appeal to the government. If an amateur can take the shot it's probably not worth paying for, and I realise the "digital revolution" is hurting the local wedding type photographers livelihood, but there's still money for the decent guys out there.

Since getting into photography the amount of photos I've seen that I wouldn't even upload to my flickr, yet "pros" have charged people for makes me cringe, at least this "revolution" should make the "pros" up their game a little.

Anyway, I'm still not signing it. And if your st has bones in I'd go and see a Doctor right away as that's probably serious.
