Purchased some RAM for my fience's PC from ebay. It arrived and did not work so sent it back for them to change it. At this point decided to pay a little extra for some better RAM. It was posted on the 16/07/09 and never showed up. After a few emails this is the latest

In any case, if package is lost, we work with customers to get their monies back through insurance. Some customer may not have purchased insurance, but if they have created win win by giving us POSITIVE Feedback and 5 Stars, we do work with them.
Many customers have asked how can we expedite this. There is no way to do so, BUT we can work with you in creating a win win scenario.
If you have given us or give us POSITIVE FEEDBACK and 5 STARS on eBay Feedback, then we would not wait for insurance company and start working on refund or replacement.In this case even if you have not purchased insurance, we will ensure your satisfaction.
If Neutrals or Negatives are given, then we will not act and allow you to work with insurance company if you have purchased insurance.

I'd agree about misuse of the feedback system, but they sent you the RAM, and you've said its faulty, but they dont have it back. From their POV, its still your problem (though they are willing to refund to keep their + ratings.)

The fact that they sent you the first lot of RAM suggests they are not out to scam you.
Reply to them, asking if they mean that they will definitely send a replacement immediately if you give them positive feedback. The wording is a bit strange but it might just be that they are not a native English speaker.
If they reply that they would then assure them that you will give positive feedback as soon as you receive it.
I would imagine once you get ebay or paypal involved they will just drag it out and try to screw everyone, as seems to be their way.

The way I read it the second lot was sent out but not received by the OP, not that the seller hadn't received the returned RAM.As far as I can see, you've lost it...

They have received my faulty RAM and have told me so (was sent recorded delivery)
It's the new more expensive RAM that has been "lost" that was on its way to me. So I am sure its up to them if its insured not me. After all if I sent a package not recorded and it went missing it would be my fault and not the person who I sent it to.

Yes, if it is something they have sent to you, then the responsibility to make sure that you get your item is with the person that is sending it. If they want to chase it up with the Royal Fail, or a courier or whatever, then that's upto them, in the meantime they should refund you.They have received my faulty RAM and have told me so (was sent recorded delivery)

Start the dispute and escalate it soon, you only have 45 days with Paypal
