Fair doos. If there is this agreement, and Apple have ignored it then so be it!

Can't really understand why they have waited two years to do this though. Maybe their recent losses have something to do with it?

Exactly what I thought. Sounds like they were more than happy to let Apple use away, and then as soon as the iPhone starts outselling Nokia and they start making losses, they suddenly cry about it. Not sure how far this one will get, but will be interesting nevertheless.
