Xbox game, disc read error - could I take it back?

I got FIFA10 from Tesco when it was released about a month ago, was playing the other day and it stopped and said 'Disc Read Error' or something like that. I haven't really taken it out ( not played on it much! ) so I wouldn't have thought the disc would be damaged, another game works fine in it so it does seem to be a problem with the game.
Would I be able to take a used game back to Teso? I haven't got the receipt but probably bought it on my card so would have a statement somewhere?

Will try it with a few other games later just to check it is the disc, hopefully it is as the repair warranty ran out on the 7th! Great timing
