A teenager who kidnapped and raped a five-year-old boy, eight days after avoiding custody for another rape, has been detained for at least three years.

Judge Adrian Smith originally gave him a community order for raping a seven-year-old in Greater Manchester.

But on Wednesday at Manchester Minshull Street Crown Court the 16-year-old was given an indeterminate sentence for public protection.

He must serve at least three years in detention

I can't - not when you can get nine months gaol for riding your legally owned, taxed and insured motobike at 170mph - without crashing.

An inquiry into the use of Polic cautions found that 111 people from 2004 to 2007 accepted Police cautions FOR RAPE offenses

There is a very simple explanation; the criminal justice system in the UK doesn't work, it does not deter criminals and fails to protect us by locking them up. The rot set in with the drafting of PACE, which was a necessary reform but ended up becoming a criminal's charter. Neu Arbeit have finished it off with their vast incontinent output of useless and counterproductive legislation. Roll on the revolution; I think we should raffle the opportunity to pick which cabinet minister gets put up against the wall and shot first.

The parents of the first victim were Christian and asked the judge to forgive the rapist rolleyes

Unfortunately this demonstrates the problems of adhering to a religious belief.

Had the first family not asked for leniency then probably the rapist wouldn’t have been at liberty to commit the second offence. I accept that it probably helped the original family move on but social responsibility also applies.

Perhaps if they wanted the rapist to be more Jesus like, they should have demanded he be crucified.

There seems to be a concept that everyone under 16 is a sweet natured innocent, clear must judges were never children.

Don't bet on it.

Sarah Paynes killer was on parole at the time of her killing. Apparently, his previous conviction was kidnapping and raping of some other poor soul, but the judge gave an unduly lenient sentence for no reason at all.

When it came out, there was a big fuss in the press, and the original judge was hounded to apologise, something he never did.

So did these parents have a bearing on the outcome of the first trial? I doubt it. And since when does anyone listen to a Christian anyway?

In these cases they would be where the victim refused to co-operate or support a prosecution.

They are issued to ensure rather than no outcome that the individual is put upon the sexual offenders database.

I agree with you but I'm curious to do with his age how?

I simply don't get how any court would look at a 15-16 year old who raped a small child and thought a Community Order was appropriate because of the offenders age i.e. old enough to know right from wrong.

Section or apply some form of "treatment" but the implication is that he was only "punished" with the Community Order.

Depends how old he is when he did it etc.

It's really really difficult to put a 'child' in prison.

I'm not sure I understand. The rape victim refused to co-operate or support a prosecution?

Basically plea bargaining - the aggressor walks with the only punishment being on the sex offenders register for some period?
