Hi all,

Was wondering if anyone could help me. I read in a another post that "Transport for London have to adhere to a 14 day issue code of practice".

Now on my pentaly charge notice it says the "date of contravention" is 01 Oct 2003 and the "date of this notice" is 15 Jan 2004. This is clearly oustide this 14 day remit.

Even worse I've only received it on 22nd Jan, already 7 days into the 14 day reduced rate period!

So what I'm asking is does anyone know if I have the right to appeal based on this info? And if so has anyone else been in this situation and successfully appealed?

Code of Practice for The London Experience -

The aim was to make the trial self-funding through the issue of PCNs. The process for issuing a PCN is as follows:
• the CCTV operator reviews all recorded offences after the bus lane ceases operating for the day;
• the CCTV operator and a supervisor check each case to make sure an offence has occurred;
• the CCTV operator obtains registered keeper and vehicle details of each offender from DVLA;
• the CCTV operator checks the vehicle description against the CCTV image;
• a PCN should (NOTICE should not MUST)reach the registered keeper within 14 days of the offence; and
• the Transport Committee for London’s Parking Appeal Service deals with any appeals.

Nothing ventured - nothing gained. Your ticket should have details of how to make an Appeal so get a letter off to the London Parking Appeal Service pointing out the extraordinary delay not only in sending the Ticket but also beyonf a time which you were entitled to the reduced payment. If might work?

Thanks for that. Actually done a bit more research and found the regulations on the department for transport website:

The wording used does imply that notice 'MUST' be served within 14 days, however after calling them up, there are circumstances where this may not be the case i.e. delays in getting DVLA records to find out owner etc.

However, the site also lists 11 pieces of information that the penalty charge notice MUST state. The notice I received, at last count, and as far as I can make out, only mentions 7 out of these 11 pieces of info.

Not sure where this is gonna end up but am definitely going to appeal now .....will post an update when I hear back.
