Ebay issue - I am probably in the wrong....

....but here goes.
I ordered a coffee table from an Ebay store. It arrived damaged. The advert clearly stated that delivery charges would only be refunded on damaged returns.
It transpired we didn't actually like the table anyway.
I rang the seller. Told him the goods were damaged and I wanted to return the table. He asked if I wanted a replacement. I said no as it does not match the lounge.
He suggested he had a new batch of tables coming in and it was agreed he would send me a photo of this so I could have a look and decide if I wanted to swap it.
He would then get his glamourous assistant to come round and pick up the damaged one as they don't live far away from me.
Got a phone call to say, "oh we can't take a photo as we would have to unwrap one" - ok, so how do you suggest you get one up on your advert, but never mind.
Anyway, the woman brings it round with her when collecting the damaged one. We don't like it so I ask for a refund of the damaged one.
No refund of delivery charge. Eh? Basis is that I was offered a replacement and did not like it therefore no refund of delivery. He argued he had gone out of his way to get me the right table, paying his woman wages to come to our house etc.
I can see his point. But my point is, if they had done as said and sent me a photo (or I was able to see the Ebay advert), I could have immediately said no.
Do I have a right to my delivery charge back do you think?

Depends what his refund policy is on the goods themselves, ie that quote implies he'll happily replace a damaged item at his own cost. But if you change your mind, that's a different kettle of fish, irrespective of the damage.

You should have checked that you liked the first table - or that it matched your lounge - before bidding on the original auction.
It being damaged when it arrived meant that the seller was duty bound to replace the table, but not to refund or replace with another style table altogether IMO.

To be fair, from the picture you could not tell that the table was basically two different types of wood! Although he did caveat that in the advert.
Damn.
