eBay advice (buyer returned item faulty)

Sold a laptop on ebay, buyer not happy (nothing that's tangible, but under the new rules I have to refund, so I told him I would), received laptop back, poorly packaged (ie. in a box with packaging on top but nothing around sides), laptop now broken.
The screen's fbar'd and just has lines running up and down.
It definitely wasn't like this when I sent it to him (was perfectly usable), and in his complaint he never mentioned the broken screen.

My eldest dropped mine a few weeks ago and initially you could only see feint cracks but over time they turned into huge thick black cracks covering half the screen.
I bought a replacement off ebay for £70 and fitted it myself.

When I sent it to him I taped air bags round the sides, top, bottom and corners. He just placed some padding in the bottom, some on the top and sealed.

Is it a tablet PC? with the spinny hinge at the bottom of the screen (looks like it)
If so you may find that the cable running through it has been pinched and damaged. We have had a couple here like that and ended up having to get Toshiba to replace them. If you have no choice then contact Toshiba and see if they will do a repair.
Check to see that the lappy hasnt been opened and had some components replaced by dodgy buyer......

I've sent him a mail pointing out that his complaints didn't mention the screen (just petty things, all b*llox really) so he confirmed it worked when it left him, and I have evidence of how he packed it unreasonably so asked for his opinion on how we resolve the matter.

- He has not lodged a resolution dispute (we conversed over ebay messaging system and I agreed to refund if he sends it back), so no need (up to now)

I've already replied to him (he's rather upset), he's saying he packaged the same way (but I taped it up with packaging so you could have dropped it off a building and it would have been ok, whereas he dropped it in).Time limit is 45 days.
Thing is once he's worked out he can press a button on ebay, he gets his funds back. Don't see what defence I have at all in the ebay/paypal world.
Can you not open a dispute with him, since you were going to refund him the money, but he has sent the item back damaged. It was his responsibility to return it I presume, and he has failed to pack it correctly. And I doubt he insured it.
I'd be tempted to send it back to him and tell him to Foxtrot Oscar, but I doubt ebay and paypal would see it that way.

Not considered he may have opened it up and changed some stuff, interesting. His initial comments were that the BIOS didn't work, wouldn't load an O/S, couldn't be formatted and the audio didn't work. All of those made no sense to me and I worked through each (ie. why do you think the BIOS is broken / what o/s are you trying to load & what's the error message / how are you finding out you can't format it / volume control works (I watched iplayer a few days ago). He was very evasive without answering specific questions but insisted the audio was faulty so wanted a refund (I did point him to the physical control).

Sorry to break it to you but there is no reason to be looking at the bios of a laptop unless you are adding or removing hardware, was it supplied with a working operating system? All his words seem like distraction and subterfuge!
Start looking at all the screws for signs of tampering, I'll bet dollars to doughnuts that some of the bits inside aren't the ones you sent!
I would remove all paypal funds and visit my bank telling them in no uncertain terms to refuse a payment request from paypal. If paypal manage to get their money back then I would be straight in the bank kicking up merry hell and demanding the money is claimed back as the payment was no authorised.
I would contact paypal telling them what has happened, tell them that you are disputing his version of events and as such are not willing to do a refund. this way they have been told that you will not refund and the bank have been told.
Then message matey saying that you have had the laptop apart and the serial numbers inside don't match the ones you sent, you may hear no more of it!
