On Monday 21st December I order an item from an EBay seller, using Buy it Now, paypal. Several of the item are in stock, and it's 24 hour courier delivery. Now the weather was bad, it's nearly Christmas, and I'm not really expecting next day delivery, although that would have been nice.

No response from the seller, until today. Sorry, this reason that, reason, warehouse not open til 4th Jan, can send then, £10 off the price. So I say OK then will expect 5th January.

I get an email back- they will send him the goods on the 4th, so hopefully he can send them to me on the 5th.

So what this means is that when he took the order, he didn't have any in stock, and therefore could not possibly have sent them 24hour service even if conditons of weather and season were ideal. In effect, the listing was a lie.

Should I leave bad feedback for this (he's got 100% at the moment)

I wouldn't be too hard on him, at least he's keeping you informed.
One bad feedback can have a suprisingly bad effect on a seller rating.
He could lose top seller status. To give you an idea as a shop seller
myself I had 7 low ratings for speed of delivery out of a feedback of
1200 and lost my top seller status for the moment.

But what about the fact that he is advertising goods that he doesn't have in stock, and offering 24 hour delivery when he couldn't possibly supply that?

But does the guy really deserve top seller status after something like this??

Personally I would leave a neutral.

well I bet that a large percentage of shops on e-bay don't have the stock and
may well get goods sent direct from manufacturer to customer. In my case I
also have a real shop and sell between 500-1000 items a day over the counter.

How could we keep all our available stock figures up to date in the e-bay shop
when we have 500+ individual listings that could be sold over the counter at
any time?

He's giving you a £10 discount so it would be harsh to give him a negative. If you feel a bit peeved either give a neutral or nothing at all.

I wouldn't have an issue with that, because then I would be getting what the guy promised, probably, 24 hour delivery. But this isn't happening, the item is being sent to him and then he is going to send it to me, this has to be because his supplier doesn't send direct to customers, so basically the listing wasn't telling the truth.

What the guy appears to be doing is cheating, by apparently offering a service that his competitors either can't, or have to actually buy the stock before they sell it. He's not cheating me, because I can send the stuff back for a refund, he is cheating his competitors.

I think maybe he is a bit guilty if he's offering 24 hour delivery.
So maybe a neutral feedback is the answer for the op.

Does it state anywhere on his ebay store that he has a warehouse closure for xmas?

I understand perfectly why you have issues at times but my point is that whoever is "top seller" in your category is simply doing the ebay side of their business better than you at the moment.

I would hang fire on anything until you get the £10 back and the item arrives with you.

At least the seller is hoping to appease you with the partial refund. I would go neutral and explain why in the feedback text, then he has the opportunity to respond.
