Without going into too much detail, a relative of my partner died last week and talk of her will is going around the family.

Since her Husband died a few years back, she has been in a home and so left her house (which was in her name after her husband died). According to some people in the family, her house is in her will to go to her Grandson, however, her daughter has since sold the house and spent the money. Also, all of the contents (of which is rumoured to have been going to certain people) has either been sold or disappeared since the house was sold.

So how does the will work? My missus is rumoured to be getting all of her jewellery but as said, its either sold (without her permission) or missing. Same with the house, it's now sold but supposed to be being left to her grandson. Would the daughter who sold it be accountable?

Your last will and testement is a legally binding document - I think the Daughter is going to be in a bit of a pickle for what she's done!!
You need to get a solicitor involved. But as is often the way with these things, expect it to tear the family apart frown

Do you mean the assets have been sold/gone in the last week..since death???

Or do you mean she sold the house before she died....which sounds more like it. Very hard to sell a house you dont own! If old lady was in on the sale then it gets complex....did old lady agree to sell and gift the cash away?

Need more info...Will only deals with items/assets owned at time of death. Where is it...who's executor?

It seems likely that the house was sold to pay for her care home costs, and the will was probably made a few years earlier than that....so didn't take that into account.

Sounds like the will was out of date and hadn't been amended to reflect assets sold.

As a fairly sound rule of thumb, you can't leave what you haven't got.

Prepare to be disappointed...

Sorry to hear of your loss (and I mean the old lady not the money...)
