Friend of mine has just given me the bad news that he has received the usual form through the post.

Anyway I wanted to query if there was anything untoward about the timings.

He allegedly travelled through a Gatso camera at 35mph in a 30mph limit on 25th December 2003. The 30mph limit is alleged to have just started before the camera. He will confirm this in the next few days.

The car he was driving was a Hire Car and it has taken until 27th January 2004 for plod to post the paperwork and track him down.

I suspect the usual 14 day ruling is out the window and wondered if the "not-signing" the form will still be valid.

He would usually take the points but he is currently training to be a Magistrate and doesn't want this to reflect badly.

Any information/assistance would be greatly appreciated.

Yup. 14 days is to get the first NIP to the owner of the car (in this case the rental company).

They then name him as the driver, and a second form turns up.

So what can be done about the second form then. Can it be left unsigned etc?

Leaving it unsigned could be a pretty risky strategy for a trainee magistrate. On the other hand, depending on who he knows...

It there any doubt about who was driving? Does he admit to the speed? Is the paperwork in order? It wasn't a clone of the car was it?
