My brother got this through the post today. Stopped by trafpol and shown video in the back of their car at the time.

On 03 october 2003 on a road or other public place, namely A82 trunk road between Bridge of Orchy Hotel and the gorge Glencoe, I drove a mechanically proppelled vehicle, namely motor car registered number R****** dangerously and drove a) At Excessive speed b)without keeping a safe distance while travelling behind other motor vehicles c) after overtaking, pull in sharply in front of the motor vehicles overtaken, a manner did place preceding motorists in a state of fear and anxiety. I did also drive motor vehicle registration number R****** at speeds of not less than 86mph in a 60mph speed restriction d) drive in the centre of the road for the opposing carrigeway: contrary to the road traffic act 1988, section 2 as amended.

What are your opinions on the outcome? Speed checked by vascar, first offence, clean licence, car not needed for work.

Presume you are mentioning the receipt of a summons to attend Court.

S 2 RTA 88 is a serious offence in the Traffic calendar and triable summarily can result in 6 months imprisonment, fine &5,000, obligatory disqualification and 3 - 11 points. More if taken to a Higher Court.

I would suggest that this is not a case that you can defend yourself or present mitigating factors to reduce a sentence.You may find it prudent to engage a solicitor who not only knows traffic laws but also the quirks of Scottish Procedure which can differ from that of the English Law.

If all that is stated is correct, may I suggest he slows down a bit! Gives a little consideration and also, checks his mirrors more often.

Sorry mate, but is does not look good for the bruv.

tell him not to speack to the police at alll and get a solisitor.

there a good chance there drop it to due care .

Not sure quite what is meant by "drive in the centre of the road for the opposing carrigeway" but as this is a single carriageway road with a fair amount of camber in parts driving in the centre of the road could be deemed as sensible provided it does not interfere with other traffic.

Having said that, the stretch from the Bridge of Orchy Hotel to Glencoe is a fair distance and good observation should have indicated the presence of even an unmarked police car. Road probably not too busy at that time of though.

One of the great driving roads - just need to pay more attention when using it!

Well the court case has been and passed and result was 4 month ban, £400 fine and resit of his test. They reduced the charge to Careless driving. Fiscal reccomended points and a fine but the judge said he wanted to set an example so banned him. Average speed was settled at 82mph but straddling solid white lines was frowned upon despite being able to see it was safe to do so. There were 3 in a queue with him at the front and traf pol in the middle. For those that know, it was just north of the King's House, perfectly straight bit of road with a blind crest which makes it unsuitable to overtake in the day but fine at night due to headlights etc.

Does this result seem par for the course or a little harsh?

Can you still be hung, drawn and quartered up there?

Sounds pretty bleak for your brother - hope it doesn't go as bad as it could.
