Splitting up advice
Discussion
My 'friend' is in the process of splitting up from his wife, they've been married 5 years, have 2 kids, a house with about 60% equity. Assuming my mate leaves, he wants to ensure that the kids have somewhere safe to live - should he be giving the house 100% to his on the proviso that she doesn't get to touch pensions, cars, etc?

Your 'friend' has no idea how unpleasant his life will become.CH
my "friend" left my, I mean his wife of 8 years last august. a few facts on that split to give you some thoughts to mull over...
have a seperation agreement in place that outlines what I (he) pays to wife to cover mortgage, money for child and payments for school fees. Shared care arrangement means child is with me for 50% of the time with a rota in place so the child (6 yeard old) knows what is happening and both parents can live a life with an ellement of planning.
Solicitor has been visited and questions asked around financial split ahead of any divorce... this would be my take on things....
you would be asked to provide care to you child first and foremost and your wife could expect to be kept in a manor of which she has become accustomed to. ie if you work and she doesn't then you will be paying her a fair sum and potnetial have o give over a larger % of the house. if she works and it's pretty equall (as in my case)then a fairer equity split without the need for ongoing spousal maintainance payments under a "clean break" would be favoured by the courts.
plenty of stuff on line giving guidance although every case is different. as i say, just my opinion and one that might come round to shaft me when i get served some paperwork....
good luck either way.

But on a serious note, someone told his wife that she was entitled to 70% of everything... which seems odd to me - I've never heard of this magical 70% figure?

Maybe. Maybe not. You need to talk to a solicitor pronto. In the meantime, this might be useful:CH
