Way back in october I had a run in with a lamppost. My car was written off (reg H690 XCP)
The lamp post was absolutely fine. No problems at all. The car obiviously wasnt.
Anyways, Ive just had an invoice from Warwickshire CC for £70.73. No letter just the invoice. I presume for 'damage' to said lamppost.
So, here is the rub. On the invoice they have my name wrong. They have Mr Hayley when I am, in fact, Mr Halley.
Also, they have my reg wrong. They say H 690 XCD when the car was H 690 XCP
I have 21 days to pay.
So, where do i stand? If i write them a letter claiming that I am not Mr Hayley and I have never owned or driven H 690 XCD what do you guys think will happen?
If i just dont pay, then what?

It appears from the Council's invoice that Mr Hayley, driving a vehicle registerd number, H 690 XCD has caused damage to one of their lamp-posts.
I suggest that, in the first instance, you reply stating that you are not Mr Hayley, have never owned a vehicle registered number H690XCD and have no knowledge of damage being caused to a lamp-post (or whatever words the invoice uses). Just that, nothing else.
Then wait for their response and act according to your conscience. But, I would want a clear statement of the damage caused, how caused, when caused, etc. with a copy of the engineer's report. After all, any damage might have been caused previously or subsequently, and they are looking for you to take the rap! It's been known to happen.

Just pay it and get it over with. You DID cause the damage after all.
Do they accept this as a typo, or will they charge the owner for displaying a falsified number plate?
If your car was insured you can pass this invoice to your insurance company to pay for the damage, this will be dealt with under the claim for the total loss of your car..

I didnt notify the police didnt claim for the loss car was only worth £900 plus the farmer was looking for the number plate of my car in his field over the weekend. There was plenty on glass metal engine bit etc but no number plate.
Just write back to them saying that you are not mr Hayley and you have never owned a car registration number xxxxx then to be honest knowinf WARKS council they will leave it and forget about it. for £70 they will write it off.

Very good! Id been driving for a few years in my old mans car, but the Golf was the first one i'd owned. I got majorly caught out by the lack of ABS. oops.
By the way, if the WCC can be arsed to get my details right on the invoice i dont mind paying.

Yes but it still leaves the question of harassment. The BIB / council knew he was insured so why not send the bill direct to the insurance company? I would return the invoice with a letter detailing the name of my insurance company and my solicitor. I would also threaten civil action for the stress caused by receiving said invoice and promise any further attempts to contact me for the purposes of extorting funds, will be met with counter legal action. That will put an end to it.
