I have a rental property that I want to sell, however I have a tenant in it.

They have been there over 4 years and are in arrears by about £400. They lost their job and ended up on benefits, but there is a shortfall of about £20 per month which has been building up.

The agreement is on a rolling monthly basis now, but I need to know how to get them out before I sell it.

Does anyone know what I need to do?

Why do you wasnt to get the tenant out? Many people would prefer to buy a rental property with a tenant in it as it saves them the costs of finding a tenant. Yes he might be paying slightly under the rent but surely you just reduce the rent to that level? Then the income is pretty much guaranteed.

A month or two empty, and a redecoration wouldcost more than the arrears in rent!

If you have allowed the original Assured Shorthold Tenancy Agreement to simply roll over and run on, then what you now have is a Periodic Tenancy Agreement. This type of Tenancy runs from week to week, or month to month, depending how the rental payments are made. If the tenants wish to bring to end a Periodic Tenancy, then where the rent is paid monthly, and due on the 15th of a month, then the tenant needs to give one months Notice on the 15th of a month (example 15th February), for that Notice to end on the 14th of the next month (example 14th March). For the landlord to bring the same Periodic Tenancy to an end, then the landlord needs to give TWO months Notice (example 15th February) for that Notice to end (example 14th April).

The Notices need to be in writing, in the landlord’s/OP’s case by way of a section 21 Notice. Should the OP require a copy or an explanation in completing the same, then the OP can pm me.

Cheers for replies guys, I want to sell it empty as I feel I am restricting the potential purchasers by leaving him in it (he's not nice to deal with either)

I'll serve him this Section 21 (thanks Wings) I've found one on google.
