Iphone 3gs and Itunes

Everything is tagged in your iTunes account. Did you download direct to the phone? If so then I am not sure, but they are NOT lost. Best bet is to setup iTunes on your PC (Mac or Windows) and then use your account to login. There is an option for Outstanding Downloads, but if this doesn't help, give Apple a call.
A friend had this happen and he called them up, ran through some basic stuff and they just tagged his account to allow him to download them all again. No issues and eventually they all came down.
With apps though, just click on them again and it will download them without paying - it knows your account already paid for them and allows you to download them. Not sure if this works for the music though, so worth double checking.

So you never sync'd the iPhone at any time?
If you did, then the music should be right there in your Music (Library), and it's only a matter of selecting it in the Music tab or adding it to a playlist (and selecting that) of the iPhone, when it's connected.
If you didn't, and the Restore should've backed up the iPhone's contents, then you only need to contact Apple, and explain, for them to allow you to re-download them again.

Hi yeh i have it synced but didnt back it up after the downloads i thought it was like that app store were you dont have to pay for it again but i was wrong!! i have emailed apple support and they are looking in to it for me.
I have checked all over my itunes on my pc and its 110% not there. hopefully they give me a refund and ill just but it again.
