A client of my father-in-law is driving in the UK on a Danish license. In the last two years (since he's been a client) he's racked up three "normal" speeding offences, and has two offences yet to go to court: one where he was caught speeding (50 in a 40, something like that) and being on his mobile at the same time (DESPITE having a hands-free bluetooth kit in the car), and another which came through today where he was caught doing 92 in a 50. When he's not speeding he still drives like a bloody madman and I've had the misfortune to be in front of him in my tiny yellow car whilst obeying the speed limit: it's not an experience I'd wish to repeat.

So, here are my questions:
1) What's the punishment likely to be for the two offences that haven't yet gone to court?
2) If he was on a UK license he'd have recieved a totting-up ban by now. I assume he won't, as he's on the Danish one, but is there anything that the UK courts/BiB can or will do to stop him?

Thanks in advance,

Katherine

If convicted, he is likely to receive a fine for each of the speeding & mobile phone offences, he will be liable for court costs and he'll have to pay the mandatory Victim Support Surcharge. As far as points are concerned, he may receive as little as 3 in total.

The DVLA will have created a driving record for him. And if he accumulates 12 or more points within a 3 year period, he will be just as liable to receive a totting ban as a driver with a GB licence.

Correct me if I'm wrong SS2, but on an EU licence, at the moment, a British court can only ban him from driving in Britain, he'll still be free to drive throughout the rest of Europe.

If he had a British licence, he would be banned from driving everywhere.

No, not yet other than Northern Ireland.

As I understand it if banned in UK then that does not apply to France etc etc. The problem exists in showing a lIcence to EEC authorities.

It is coming but as yet they are still working on it,

The EU is supposed to be coming in line soon, so that no matter what EU country you're in, you'll be banned

Thanks for the replies.

The client lives in the UK and goes to Denmark about twice a year, so a ban would still hit him where it hurts, assuming he abides by it. (I'm sure he thinks he's invincible & would probably drive whilst banned.)

I should also probably clarify that I'm not anti-speeding, not by any means, but he has a massive lack of awareness of other road users and drives like an absolute dick. I had the misfortune to be driving in front of him again this morning and it was horrible, I've not been so intimidated by another driver since before I passed my test.

Thanks again, here's hoping the law works as it should!

Hi there,

I'm fairly new here on PistonHeads and as i couldn't find a suitable place to get simple and straight answers i will then try it here and hope someone here might be able to help on this matter, i will much appreciate.

Ok, I'll try and make the question as brief as possible:

I am European and have lived in UK for 14 years and still hold a full EU license.

Basically i have been disqualified from driving in the UK for 6 months (long story) which took effect from the 15/09/2017
and as the 6 months will end next month ( March ) i am wondering if i should just assume that from the 15th of March i'll be able to drive as normal or is there anything else i should know or should do in terms of contacting The respective Court about it to give me some kind of ''blessing'' to get back on the road?

Reason being, i have contacted DVLA and query about it and they simply cannot help on the matter.......then I tried their online system to check ''when the disqualification ends and its procedures'' but DVLA states that non UK License holders will Not be able to use this online system...neither the D27 form....plus as they do not require me to renew my license because obviously they only hold a ''ghost license'' / Driver's record, therefore i assume i can just start driving after the date the ban ends, is that right? Is this something perhaps someone here has experienced before?

Many thanks

You have only been banned from UK roads as you hold a non UK licence.

You can legally drive in all other countries, and as soon as your UK ban ends you can drive again in the UK.

odd thing is, you can be British Citizen and also resident in UK yet still hold on to your EU licence until you're 70.
(in case you're wondering, you move out of EU first where you'll need to exchange licence. you then move back to EU but not UK and exchange licence. upon ing back to uk you have a valid EU licence for many years)

Hi all,

Thanks for the replies.

Bit confused here.......were those replies to my post on friday?
Its because if those are replies to my post i may have not been clear enough because of the answers do not seam to fully relate to my post if it makes sense?
I mentioned that i lived in Uk for 14 years but I am still living in UK....and i am aware of the license exchange times, rules and all the good ol stuff but the question is related to specifically about after when the 6 months ban ends what steps We usually take? Start driving as normal? Contact DVLA for any reason? Its because despite all the contact to DVLA about the matter, i keep reading stuff that states "one must fill out a form from DVLA as to officially confirm the very end of the ban period" so i am just wondering because i can't get any clear info about it on DVLA.
With all honesty.....i Assume i WILL just get back on driving straight after the day it ends which is on the 15th March 2018, so i am just probably being too worried about it but i need to make sense out of this.

You can actually register your foreign licence with the DVLA, useful info here.

My thinking is, register your (currently suspended!) licence, then you may be able to use the DVLA site

You might have been better off creating your own thread, rather than tagging your question to a 7 year old thread.

That said, I would assume that you can drive once the ban expires. Should you be stopped by the police, they will check your record and see the expired ban. Personally, I'd consider waiting till the 16th to be sure there is no overlap on dates/times (i.e the ban expires at 23:59 on 15th March) Presumably you have your license, and its not held by the DVLA for some reason.

I'm not a lawyer though smile

@ esxste

That's exactly the answer i was looking for thank you!

They cannot have my license because it is not a british one. I can only abide by the rules of just simply ot driving for the ban period. Even when i was in court they admited they cannot keep a non British license but as long as the "ghost / driving record" created by DVLA is respected in terms of myself Not driving during the ban period.
And yes that is my plan to leave it 2 or 3 days after the ban ends and then get ack on the road.
For the ones who suggested to "register my license with DVLA so then i can use their website", i must say that it does not work that way because they do have my license details from the moment i filled the "paperwork" as for the fines also hence them creating the "number for the ghost license or driving record with my name on it". And it always states "please send your license to DVLA, OR if you hold a non British license , please send a photocopy of the license and send it to DVLA.
So all in all, i will start driving 3 days after the ban and thats it i assume.

Thanks everyone for the replies.
