Hello All,

Anybody know the law on this? I've just been advised that my salary is going to be delayed this month - probably by 7 days. Anybody know if this is a breach of contract?

Sounds to me like the company you work for is in deep trouble.

The contract says "Salary paid monthly in arrears."

Company not in fantastic shape and this is not exactly a suprise!

your contract usually states "on the last working day" etc your comapy I would suggest is in breach since it would only be a "calendar month" If you have always been paid on the 1st then this could constitute the contract if it is not in writing.

You could refuse and see what they do, or to help (i don't know how big your company is) offer to take 75% and defer 25% as a one-off goodwill.

Your problem is they will do this again next month...or not pay you, you would be the first member of staff working for free with company going down the pan.

Hopefully you've got savings to fall back on. I also think that the Company is having cash problems...It doesn't really matter what your contract says - if there's no money, you're not going to get paid.
If the company goes bust you'll get your money back eventually through the insolvency service...hopefully that won't be the case. smile

Talk to them and find out what the problem is. It could just be a cash flow issue with a customer who has let them down paying a big bill. It's happened to me once or twice in the past, but we did always manage to pay the paye...

Alternatively, you could be an unpaid rat on a sinking ship.

Go with your gut.

Jump ship before it sinks.

I worked for a company for a little while where they'd pay my salary late and I'd get emails saying that they were struggling to raise capital to pay salaries. 2 months later (a week before I left) approximately 1/2 of the staff were laid off (I'd resigned by this time and was working my notice period). A month later the company had pretty much just a skeleton staff left - everyone got laid off just before Xmas.
