Shafted over a new job
Discussion
Basically my son works in a lab in Nottingham (nice place but poor pay) applied for and was offered another job.
Hands in his notice at present work and has just 3 days to go. Arrives home last night and recieves a phone call from the job agency. The new company have now decided not to recruit and therefore the job is no longer available.
This leaves Matt in a mess having given up a perfectly good, if lowish paid job and having his new job snatched away at the 11th hour.
He has rent and living to pay for and is feeling well and truly shafted! He may even have to move back home
Anyone been in a similar situation ? Is there any point in trying to sue the new company for breach of contract, all done thro recruitment agency tho so he has no written agreement.
Any ideas appreciated Dave.

as above.
I wouldn't hand notice in until an offical offer letter stating start dates, salary etc had been received.
If they went back on this offer letter you could rightly seek compensation etc.
without anything in writing you don't have a leg to stand on.
Hope you/your lad has such a letter - if not it's a harsh lesson mate.

He wasnt nasty in how he handed in his notice at his current/old job. They may be willing to take him back.
He,s leaving on good terms but of course they know that he is looking to move. I think he is going to ask if he can stay on for an extended period? Find out the outcome tonight. Edited by sherman on Thursday 1st April 12:06
As above, you shouldn't resign without an offer letter (minimum) or a signed contract (ideal).
I would imagine he would have, at the bare minimum, some form of correspondence saying 'we're pleased to confirm our offer of a job, please report for duty at.......'. In which case he would have reasonable grounds for insisting they take him on or compensating him for his loss.

I know compensation culture crowd would be along soon but what is the figure you could claim.
Difference of time in between job's?
If nothing has been signed, the new company can do what they like and there's nothing wrong with that, it's their perogative. As other have said, wait until a contract has been signed and then resign. It's very simple.Difference of time in between job's?

Its all very well saying "Don't hand your notice in until you get a contract" but IIRC is would be irrelevant anyway.
Presumably any contract has a probation period and a clause giving them the right to get rid without notice?
THus in this instance it wouldn't really make any difference.
Although, like the rest of the internet, I am no lawyer.

He has correspondance but from the agency rather than the actual company.
The woman who phoned him from the agency said in 7 years she had only known this happen one other time and that was down to bad references.
Think it will have to go in the book of 'lifes lessons' . A harsh one to learn tho.
Should get more info off him tonight and see what his old company have said. Ironically he had his leaving do on Tues night..

Can't he tell them it was an April Fool's joke?
On a more serious note: I would want to be speaking directly with the company that offered the position, not the agent. I would also ask to see proof of the job offer that was made to the agency.
Something stinks.

Oh well, looks like all your "Forest" memorabilia will have to be moved out of the spare room & back to the loft!
Weve got a French girl staying in his old room this summer ona work experience type thing, wonder if she'd mind sharing??
How do you get a French girl staying in ones spare room for work experience? A paying one, too, I am guessing?
